    La responsabilité historique désigne le fait que les pays industrialisés (comme ceux d'Europe, les États-Unis ou le Japon) sont les principaux émetteurs de CO2 depuis le 19e siècle et ont donc causé le stock actuel de gaz à effet de serre. Le principe des "responsabilités communes mais différenciées", adopté au Sommet de la Terre à Rio en 1992, traduit cette réalité en droit international : si tous les pays doivent protéger la planète, ceux qui l'ont le plus polluée et qui possèdent le plus de moyens financiers doivent fournir l'effort le plus important.

    Le Protocole de Kyoto reposait sur une approche "top-down" avec des objectifs de réduction contraignants imposés par le haut, ce qui a poussé certains grands pollueurs comme les États-Unis à se retirer pour protéger leur économie. À l'inverse, l'Accord de Paris de 2015 utilise une approche "bottom-up" où chaque pays fixe volontairement ses propres objectifs (les NDC). Ce système est complété par un "mécanisme de cliquet" qui oblige les États à relever leurs ambitions tous les cinq ans sans pouvoir revenir en arrière.

    Le concept de "Pertes et Dommages" concerne les dégâts irréversibles déjà causés par le changement climatique, tels que la disparition d'îles ou la destruction totale de récoltes, que l'on ne peut plus éviter par l'atténuation ou l'adaptation. Longtemps bloqué par les pays riches craignant des poursuites judiciaires, ce dossier a connu une avancée historique à la COP27 avec la création d'un fonds spécifique destiné à dédommager les pays du Sud pour les préjudices subis.

    Les pays émergents invoquent souvent le "droit au développement" pour justifier leur utilisation des énergies fossiles, affirmant qu'ils doivent d'abord sortir leur population de la pauvreté comme les pays occidentaux l'ont fait par le passé. Ils considèrent qu'il est injuste de leur imposer les mêmes restrictions qu'aux pays développés alors que ces derniers sont responsables de la majorité du stock de carbone accumulé dans l'atmosphère depuis la révolution industrielle.

    Le climat n'est plus seulement une question écologique mais un levier de domination économique et diplomatique. Par exemple, en devenant leader des panneaux solaires et des batteries, la Chine s'assure une influence technologique mondiale. De plus, le leadership climatique renforce le "soft power" d'un État : un dirigeant qui ignore les enjeux environnementaux perd aujourd'hui en crédibilité et en influence sur la scène internationale.
