Sur le plan éthique, l'état de santé des accusés, qui comparaissent parfois sur des brancards, interroge sur l'humanité de la justice. De plus, la fonction de la peine perd de son sens puisque la réinsertion est impossible et le risque de récidive est nul chez des personnes en fin de vie.
