You can protect these by creating a digital trail with timestamps to prove original ownership and by implementing "reasonable measures" to keep the information secret. Moving files to secure, private cloud storage and using non-disclosure agreements (NDAs) for all new collaborators helps re-classify your value from public knowledge to protected trade secrets.
Several legal frameworks address this behavior beyond simple "mean" conduct. "Tortious interference" occurs when someone intentionally disrupts your business relationships or contracts for their own benefit. If they use false information to get you removed from a space, it may involve defamation or corporate sabotage. Additionally, "conversion" or "breach of fiduciary duty" can apply if they have misappropriated assets or information they had a duty to protect.
The Blue Ocean strategy involves moving away from a "Red Ocean" filled with toxic competition and "sharks" to a completely new market space where the predator cannot follow. Instead of fighting to get back into a contaminated gym or social circle, you build a new program in a new space with updated legal protections. This renders the predator irrelevant because they only have the map to your old version; they cannot copy your future growth if you stop providing them with the "source code" for your innovations.
Strategic silence prevents you from falling into a "reputation trap" where the predator tries to make you look like the aggressor. Publicly attacking a rival often provides them with more data on how to trigger you and makes you appear unprofessional to stakeholders. By remaining silent and professional, you maintain "strategic sovereignty," allowing the predator to look like a "copy-paste artist" while you quietly build a superior, legally fortified version of your business.
